DMCA TAKEDOWN POLICY

1. OVERVIEW

This DMCA Takedown Policy is to be used only for reporting infringing content published on dazzler.me. To request assistance with removing infringing material found on other websites, please contact us here: support@dazzler.me.

Dazzler (“Site”) respects the intellectual property rights of copyright holders and has chosen to voluntarily comply with the Notice and Takedown provisions of the Digital Millennium Copyright Act (“DMCA”). This Site qualifies as a “Service Provider” within the meaning of 17 U.S.C. § 512(k)(1) and is entitled to certain protections from claims of copyright infringement under the DMCA, commonly referred to as the “safe harbor” provisions.

 

2. NOTICE OF CLAIMED INFRINGEMENT

If you believe your work has been copied and published on dazzler.me in a way that constitutes copyright infringement, please provide our Designated Copyright Agent with the following information:

  1. An electronic signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

  2. A description of the copyrighted work or other intellectual property that you claim has been infringed;

  3. A description of where the material that you claim is infringing is located on the Site (preferably including specific URLs);

  4. Your address, telephone number, and email address;

  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

  6. A statement, under penalty of perjury, that the information provided in your notification is accurate and that you are the copyright or intellectual property owner or authorized to act on the owner’s behalf.

Please do not send other inquiries or information to our Designated Agent. This policy applies only to infringing content published on dazzler.me. Our Designated Agent is not authorized to accept or waive service of formal legal process beyond what is required to accept valid DMCA Notices.

 

3. ABUSE NOTIFICATION

Abusing the DMCA notice procedures or misrepresenting facts in a DMCA Notice or Counter-Notification can result in legal liability for damages, court costs, and attorneys’ fees under federal law (17 U.S.C. § 512(f)). These procedures only apply to claims of copyright infringement by copyright holders and their agents—not to other types of abuse or legal claims. We will investigate and take action against anyone abusing the DMCA notification or counter-notification procedure. Ensure you meet all legal qualifications before submitting a DMCA Notice.

 

4. TAKE DOWN PROCEDURE

Upon receipt of a valid DMCA Notice, the Site will promptly remove or disable access to the infringing material and notify the affected user. The Site reserves the right to disable access to or remove any material or activity that appears infringing. Repeat copyright infringers may have their accounts terminated.

If the Notice does not fully comply with DMCA §512 but meets basic requirements to identify infringing material, we will attempt to contact the complaining party to help them comply.

 

5. DMCA COUNTER-NOTIFICATION PROCEDURE

If a recipient believes that content was removed in error, they may submit a counter-notification pursuant to 17 U.S.C. § 512(g)(2) & (3). A counter-notification must include:
1. A specific description of the material removed or disabled;
2. A description of where the material was located on the Site before removal;
3. A statement, under penalty of perjury, that the material was removed due to mistake or misidentification;
4. The recipient’s physical address, telephone number, and email address;
5. A statement consenting to the jurisdiction of the Federal District Court for their location, or any judicial district where the service provider may be found, and acceptance of service from the original claimant.

All DMCA notices and counter-notifications must be in English. Notifications in other languages will be disregarded. After receiving a compliant counter-notification, we will forward it to the original claimant and may restore the disputed material within 10–14 days unless a court action is filed.

 

6. MODIFICATIONS TO POLICY

The Site reserves the right to modify, alter, or add to this policy at any time. Users should regularly review the DMCA Policy to stay informed of any changes.

Please note that the DMCA Agent is not associated with the Site in any other capacity. Customer service inquiries, payment questions, and cancellation requests must be directed to the Site's customer service department.
